(3) Identifying the real need of the parties
The mediator needs to identify the real need of the
parties from the information and facts that he/she has received,
which can be from a joint negotiation or from his/her separate
meetings with each party (Caucus).
(4) Determination of conflict resolution
It is the duties of the mediator to minimize conflicts and
propose conflict resolution.
8. What would happen if the post - judicial
mediation succeeds?
Answer
In case of successful mediation : The legal execution process
will end when the parties are able to reach an agreement. The
parties will be compensated to the extent that satisf ies them
and creates good relationship between them.
Additionally, the parties may enter into an agreement
which is legally binding and is deemed in existence as a result of
the judgment. Neither party can terminate the agreement or act
differently without the other party’s consent (pursuant to the
Supreme Court judgment No. 1950/2551).
