3. Wheat are the main characteristics of
post - judicial mediation?
Answer
(1) After the judgment is awarded.
(2) At least two parties are involved.
(3) There is an impartial person to assist the parties in the
negotiation but does not serve to determine the outcome.
(4) The parties voluntarily decide to have the impartial
person to assist them.
(5) The outcome is a result of the parties’ decision.
4. Who is the mediator?
Answer
“Mediator” is an impartial person whom the parties agree
to assist them and guide them towards their own resolution.
The mediator can be an outsider or an executing off icer.
5. How many types of post - judicial mediation?
Answer
(1) Pre - legal execution mediation takes place before
a seizure and attachment of the judgment debtor’s property
is enforced. The parties may ask for mediation and a stay of
the legal execution process which can eventually lead to
a withdrawal of the legal execution process.
