the rapid and eff icient outcome which allows the parties to reach
a mutually satisfactory settlement of their dispute and continue
to maintain their relationship, mediation is one of the contributing
factors to a peaceful society by reducing the number of cases lined
up to the legal execution and allowing the parties to participate
in settling the legal execution by themselves.
2. What is post - judicial mediation?
Answer
Post - judicial mediation is a mean to resolve disputes in order
to end the legal execution process by having an impartial person
called a mediator plays a role in facilitating and giving advice to
the parties so that they can mutually agree to resolve the disputes.
If successful, it would lead to a withdrawal of property seizure,
property attachment or the legal execution process through
a written agreement which are legally binding.
In mediation, the parties are assisted to reach the mutual
agreement whereby mediator serves as an instigator, adviser,
persuader, translator, or guide toward possible resolution to
the dispute. Unlike an arbitrator or a judge, a mediator is not
authorized to determine the agreement for the parties. It is
the parties’ sole decision to reach the agreement.
