Question
What is does an intervention mean? Can an enforcement officer put a
property under an intervention up for a sale by public auction and how is it
done?
Answer
An intervention refers to a case in which a person claims that the
property seized by the enforcement officer does not belong to the judgement
debtor. Upon receiving a copy an intervention request, the enforcement
officer must stay the public auction of the property under request to await
the court’s final judgement. If the court rules that such property belongs to
the judgement debtor, the enforcement officer can then proceed with the
sale by public auction.
