Question
If after having bought a property at a sale by public auction,
the defendant or his or her attendant still dwells on the property, can
the buyer take possession of the property upon completion of the title
transfer ?
Answer
In the case that there are dwellers on the property, whether it is the
defendant or his or her attendant, the buyer cannot immediately enter the
property but has to submit a motion to the Court for issuance of a writ
of execution to remove the defendant or his or her attendant from the
property. The buyer must lead the enforcement officer to remove the
defendant or his or her attendant before taking possession of the property.
