If after seizure and sale of a debtor’s properties by public auction, the
plaintiff still has not received full debts repayment, can the defendant
request for an extension of debt repayment? If the defendant cannot
repay the remaining debt, will the defendant be subject to a bankruptcy
proceeding?

Answer

Whether an extension of repayment period for the defendant’s remaining
debt is possible or not depends on a mutual agreement between the plaintiff
and the defendant. If the defendant is an insolvent person and if the remaining
debt is in excess of 1,000,000 baht (for a natural person) or 2,000,000 baht
(for a juristic person) the debtor may be subject to a bankruptcy proceeding.
