Question
When a debtor is the child of a deceased and inherits land from the
deceased, can I ask for seizure of such inheritance (land) from the debtor?
Answer
The owner name in the land title document must be changed to the
debtor’s name before a seizure can be performed. If the debtor is the
deceased’s heir/heiress and is entitled to receive such inheritance (land)
but the owner name in the land title document has not yet been changed
to the debtor’s name, the inheritance cannot be seized. If a creditor
files a request to have an enforcement officer seize such property,
the enforcement officer will dismiss it. The creditor must file a motion
to the court to order the enforcement officer to seize the property
within 15 days from the date that a motion is submitted to the Court for
issuance of an order to have the enforcement officer seize the property.
If the court issues such a seizure order, the enforcement officer will be able to
perform the seizure.
