Question
In the case that a debtor has been subjected to a salary attachment
and has resigned from work but still pays the same amount as the
original salary attachment, can this be done? If the debtor wishes to pay
the debt in full, how should the debtor proceed?
Answer
A debtor can pay the original amount of attached salary but should
submit evidences of leaving the employment and inform the enforcement
officer that he or she wishes to continue debt repayment as specified in
the writ of execution. When the enforcement officer receives payment from
the debtor, the officer will prepare a distribution account and notify the
creditor(s) to collect payment.
If a debtor wishes to repay the debts ordered in the writ of execution
in full, they can ask the enforcement officer to calculate the
amount of the remaining debts together with all fees and The expiration of the 6 month detention
charges and deliver the full amount to the enforcement officer.
Once the debts are repaid in full, the
enforcement officer will terminate
the salary attachment and case
execution under the current Civil
Procedure Code. In the case where
there are multiple creditors applying
for debt repayment, the debtor must
made full debt repayment to all
creditors before the enforcement
officer can terminate the salary
attachment and execution.
