Answer

The creditor must submit the debtor’s certificate
of juristic person registration, which is certified within
one month by a registry officer, to the enforcement
officer for an accuracy check before performing
a seizure.

In the case that a creditor wishes to request
for seizure of the debtor’s properties in the form
of a motorcycle or car, what documents are
needed to supplement such request?
Answer

Submit the owner manual of the motorcycle or car or its copy to the
enforcement officer for checking. If the debtor is found to be the owner,
the enforcement officer will seize it, but will not do so if its ownership is in
another person’s name. Moreover, the creditor must request a copy of the
motorcycle/car owner manual from the Department of Land Transport or
a Provincial Transport Office and have its officer certified the copy.
